Conditions of Use

PAYMENT TERMS: Customer shall pay for the products listed within this order pursuant to the payment terms listed on the invoice (standard payment terms are net 30). Customer agrees to pay the amount of any taxes resulting from this order. If payment is not made to BioHorizons in accordance with the payment terms set forth therein, BioHorizons may add a 1½% finance charge per month for any unpaid balance and the Customer shall be liable to BioHorizons for all reasonable attorney fees and costs incurred by BioHorizons to effect collection of any order unpaid in whole or part. In addition, BioHorizons reserves the right to suspend all future shipments until all payments have been received.


DISCOUNTS, REBATES AND DISCLOSURES: The prices stated in the order or statement may reflect a discount or be subject to a rebate. You must fully and accurately report this stated discount price, or if applicable, any net pricing, after giving effect to any rebates, to Medicare, Medicaid, Tricare and any other federal or State program upon request by any such program. Accordingly, you should retain these records. It is your responsibility to review any agreements or other documents applicable to these prices to determine if they are subject to a rebate. The federal government imposes certain restrictions on, and requires public reporting of, transfers of value to a practitioner. Participating in a promotional discount program (e.g. points, discount redemptions or other special awards, except for BioHorizons goods and services) is only permissible if your practice is neither enrolled in nor bills any federal health care program (e.g., Medicare, Medicaid, Tricare or Children’s health Insurance Program) for dental, oral surgery or pharmaceutical services. By participation in such discount program, you agree that to your knowledge, neither your practice nor your patients are enrolled in or reimbursed by federal programs for such services.

 

RETURN POLICY: BioHorizons implants and prosthetic components (except O-Rings and Nylon Inserts for Ball Abutments) carry a Limited Lifetime Warranty. We will provide a replacement for any BioHorizons implant or prosthetic component if removal of that product is required for any reason, at any time. In the event an implant is removed within 36 hours of placement (same day removal), or is opened (removed from its original packaging) and unused, BioHorizons shall provide a replacement at a cost of $75 ($95 if Laser-Lok®) each plus shipping. To qualify for a free warranty replacement or a same day removal replacement fee, BioHorizons requires (a) lot and reference numbers, (b) dates of placement and removal, (c) reason for removal, and for implants (d) a completed Warranty Claim Questionnaire.


For the return of any distributed product (product of which BioHorizons is not the manufacturer), including warranty returns, the manufacturer’s return policy, including their restocking fees, if any, shall apply.


** Returns of biologic grafting material must be made within 10 days of receipt of the product. **

(NOTE: BIOLOGIC PRODUCT MUST BE RETURNED VIA 2ND DAY AIR AT A MINIMUM.)


Other products, excluding VIP-related product, may be returned for full credit up to 30 days after the date of shipment provided: (a) it is returned to BioHorizons freight prepaid and (b) it is in its original unopened, uncompromised packaging. Under no circumstances can BioHorizons accept product for return or exchange that has been used clinically. Product returned 31-60 days after shipment from BioHorizons, and in compliance with the provisions stated above, will be assessed a restocking charge of 20%. Please contact your BioHorizons Product Support Specialist or BioHorizons Customer Care for returns of product beyond 60 days from date of shipment. Any items authorized for exchange must be in their original, uncompromised sterile and/or tamper-evident packaging (implants must have at least 18 months remaining before expiration; sterile prosthetics must have at least 1 year remaining before expiration).


BioHorizons reserves the right to refrain from issuing any warranty replacements or exchanges when an account is on financial hold.
